IRS Tax Debt – Remedy
Most would agree that getting a notice from the IRS is a stressful event. The IRS has many ways to punish delinquent taxpayers. However, depending on your situation, there are usually multiple remedies available when the IRS determines you are delinquent.
One of the ten maxims of commerce is: “An agreement is a contract and must be honored.” Contracts, once entered into freely and knowingly, are binding and must be fulfilled according to their terms. When you sign and file your tax return with the IRS, you are entering into a contract with them.
Therefore when the IRS sends you a notice which contradicts the terms of the original contract (your tax return), you should know that the IRS is attempting to renegotiate your tax return. How you respond to this notice from the IRS is critical.
REKTIFIRE has been assisting clients, for many years, with custom remedies that:
1. Block the IRS from changing the original tax filing
2. Offset / Discharge the new tax charge presented by the IRS
3. Block IRS collection actions (e.g. tax refund confiscation, bank account freezes and transfers, wage garnishment)

When you receive a notice from the IRS, you are almost universally given two options:
1. Pay the new tax amount
2. Request an appeal hearing from the IRS
Neither of these are good options. If you pay the new tax amount, you essentially agree that the IRS has jurisdiction to charge the new amount, you agree that you owed the new amount (since you paid it), you waive your right to challenge this tax amount in the future and worst of all you invite the IRS to add new unconfirmed tax charges to your account in the future. If you request an appeal hearing with the IRS, you commit yourself to a long drawn out battle of document exchanges where the IRS denies all of your evidence and motions which eventually results in your appearance before an IRS administrative “judge” who is judge, jury and executioner of the IRS rules. REKTIFIRE has actual experience where IRS administrative judges ignore the intent of their own regulations rather than grant relief to a taxpayer.
However, you have many more options at your disposal. To discuss your current situation and time tested options that align with your goals (e.g. minimizing your taxes) then click on the “Free Consultation” button below.
